Terms of Service

These Terms of Service ("Terms") govern your use of gocrest.org and the Crest predictive drive-failure detection service (together, "the Service") operated by Crest Technologies Pvt Ltd ("the Company," "we," "us," or "our"), registered at Cyber Gateway, Block C, HITEC City, Madhapur, Hyderabad, Telangana 500081, India. By accessing or using the Service you accept these Terms. Nothing in these Terms limits any statutory rights you hold under the laws of your country of residence.

1. About the Service

The Company provides a predictive storage reliability service for SRE and infrastructure teams. The Service deploys a lightweight read-only agent on the customer's storage hosts, ingests SMART attribute data and NVMe health telemetry, applies a failure prediction model, and delivers risk alerts and scores through configured alert channels (including PagerDuty, Slack, webhook, Prometheus metrics endpoint, and Grafana). The Service is intended for use by organisations and professional technical teams, not by consumers for personal use.

2. Agreement

These Terms form a binding agreement between you (or the entity you represent) and the Company. If you are agreeing to these Terms on behalf of an organisation, you represent that you have authority to bind that organisation. These Terms apply to the website, the Crest agent software, the dashboard, APIs, and any documentation provided by the Company.

3. Use of the Service

  • You must be of legal age in your jurisdiction to enter a binding agreement, or have appropriate organisational authorisation.
  • You agree not to use the Service unlawfully, to interfere with its operation, or to attempt unauthorised access to any system or data.
  • You may not scrape, reverse-engineer, decompile, or copy the Service except as expressly permitted by mandatory law or by written agreement with the Company.
  • You are responsible for maintaining the security of API keys and credentials associated with your account. The Company is not liable for losses resulting from unauthorised use of your credentials.
  • You agree not to use the Service to monitor infrastructure for which you do not have lawful authorisation.

4. Intellectual Property

The Service, including the failure prediction model, agent software, dashboard, and all associated documentation, is owned by the Company or its licensors and is protected by applicable intellectual property law. The Company grants you a limited, non-exclusive, non-transferable, revocable licence to use the Service solely for its intended purpose during the term of your subscription. No ownership interest is transferred.

5. Customer Data and Telemetry

Drive telemetry and SMART attribute data submitted through the Crest agent ("Customer Data") remains your property or that of your organisation. You grant the Company a limited licence to receive, store, and process Customer Data solely to provide the Service - specifically, to operate the failure prediction model and deliver alerts and risk scores to your team. The Company's use of Customer Data for any other purpose requires your explicit written consent. See the Privacy Policy for details on data handling, retention, and the on-premise deployment option, which keeps all Customer Data within your own infrastructure.

6. Disclaimers

The Service is provided on an "as is" and "as available" basis. The failure prediction model produces probability estimates and recommended action windows based on drive telemetry patterns; it does not guarantee that every at-risk drive will be identified in advance, nor that every flagged drive will fail. Prediction accuracy depends on the quality and completeness of telemetry data from monitored drives. The Company disclaim all warranties to the maximum extent permitted by applicable law, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Mandatory consumer warranties applicable in your country of residence are not affected.

7. Limitation of Liability

To the maximum extent permitted by applicable law, the Company's total liability for any claim arising from or related to the Service will not exceed the amount paid by you to the Company in the three months preceding the claim. The Company is not liable for indirect, incidental, special, consequential, or punitive damages, including loss of data, loss of revenue, or costs of substitute procurement, even if advised of the possibility of such damages. Liability that cannot be limited under mandatory applicable law is not affected.

8. Indemnification

You agree to indemnify and hold harmless the Company, its officers, employees, and agents from any claims, losses, or expenses (including reasonable legal fees) arising from: your use of the Service; your breach of these Terms; your violation of any applicable law; or your infringement of any third-party right. This indemnification obligation survives termination of your use of the Service.

9. Termination

The Company may suspend or terminate access to the Service for breach of these Terms, non-payment, or conduct that poses a security or operational risk, with notice where practicable. You may discontinue use of the Service at any time. Upon termination, the Company will delete Customer Data in accordance with its data retention policy. Sections 4, 6, 7, 8, 10, and 11 survive termination.

10. Governing Law and Jurisdiction

These Terms are governed by the laws of India. Disputes arising from or related to these Terms or the Service are subject to the non-exclusive jurisdiction of the competent courts in Hyderabad, India, without prejudice to mandatory consumer-protection rights of your country of residence. The Company and you agree to attempt good-faith resolution of any dispute before commencing formal proceedings.

11. Changes and Contact

The Company may update these Terms from time to time. Material changes will be posted with a new "Last updated" date. Continued use of the Service after the effective date of changes constitutes acceptance of the revised Terms.
